Duarte would rewrite its accessory dwelling unit rules to allow a main house, a detached ADU, an attached or converted ADU, and a junior ADU on a single-family lot, subject to applicable standards.
The proposal would also allow up to eight detached ADUs on existing multifamily properties, capped at the number of existing homes; eliminate replacement-parking requirements when parking is converted for an ADU; and provide a path to legalize qualifying unpermitted units built before 2020, with health-and-safety requirements still applying.
City staff says the rewrite responds to a state finding that Duarte's code is out of date. Staff says it has already been applying state law when reviewing ADUs.
The City Council will hold a public hearing and consider introducing the ordinance for first reading Tuesday, Oct. 27, at 7 p.m. in City Council Chambers, 1600 Huntington Drive (agenda here). Details.
